Graduated from the University of Western Ontario with a Bachelor of Arts degree in 1966. Graduated from the University of Western Ontario Law School with a Law degree in 1969. Articled with the firm of Lerner & Associates in London, Ontario, and subsequently joined that firm, becoming a partner there in 1973 and practicing general litigation with that firm until 1981.
Since that time, I have practiced in my own firms, known initially as Nicholson, Seabrook & Epstein and currently as Nicholson Smith & Partners. Both firms have done exclusively civil and commercial litigation.
Throughout the period of my practice, my practice has been restricted to just civil litigation. My practice has included insurance issues, insurance disability claims, personal injury claims including medical malpractice and professional negligence claims. I have acted in construction lien claims, breach of contract, and general commercial litigation of all types. I have acted in many cases involving horses and other livestock. In doing so, I have acted for both plaintiffs and defendants.
I have tried many cases, both jury and non-jury for plaintiffs and defendants.
I have acted for a number of insurance companies, defending a variety of claims, including personal injury claims, claims under the Statutory Accident Benefits Schedule, and property claims.
I have appeared before a number of tribunals, including the Ontario Racing Commission, Labour Relations Board and in all courts in the Province of Ontario. I have argued many cases before the Ontario Court of Appeal And Divisional Court and I have also argued cases in the Supreme Court of Canada.
I sat as a deputy Small Claims Court judge in Southwestern Ontario for approximately five years, donating the money therefrom to the University of Western Ontario Law School.

I now act as a mediator and have been doing so since 2006. I have mediated all kinds of claims, including estate matters, personal injury claims, first party insurance claims, sexual abuse cases involving the church and other institutions, and commercial litigation claims.
In 2007 I was given the honour of being on the list of Canada's best 100 lawyers, an honour that was determined by my peers.
I was also nominated in 2009 by my peers in a LexisNexis survey as being a BV Rated Attorney which is the highest rating a lawyer can achieve after being called to the bar for at least five years indicating very high legal ability and ethical standards.More Injury Lawyers
